In opposition to a widely-held opinion, the conservatory act isn't characterized by its juridical nature, by its urgency, its small gravity or its temporary nature. the object of this act is to protect properties against a threat of loss, keeping untouched. so, the conservatory act is both a "finalized act", because it is defined by its purpose, wich is to protect the patrimonial wealth, and a "conditioned act", because it acts against a risk of disparition wich determines the forms and the intensity of its retort. sometimes juridical or material act, sometimes measures or action of law, the conservatory act naturally uses the most various instruments to fit themost heterogeneous situations and perils. but, under this apparent diversity, its saving purpose gives this act a real unity and a necessary advantageous, preventive and patrimonial nature. Also, the conservatory act has in all matters the benefit of derogatory and favourable systems. Obviously, its accomplishment is deeply facilitated because it is an exception to the rule of the juridical capacity and power of the agent and to the conditions of liquidity, payability and certainly of right. Moreover, the conservatory act is obligatory when the properties and the right's saving is necessary. But its originality also exist in the stage of its conclusion, because it takes advantages of particularly advantageous rules of indemnification and of legal guarantees, that makes it a preferred act.
