Summary:
The Protection of General Interests in the International Community. General Course on Public International Law (2011) by Giorgio Gaja. An increasing number of principles and rules of international law protect interests that transcend those pertaining to individual States. A State may then invoke the respect of obligations irrespective of the existence of a specific interest of its own. The course discusses a number of issues concerning the manner in which international law protects general interests. Among these issues are the role of the United Nations in protecting general interests, the responsibility of States for breaches of erga omnes obligations and the related question of standing in international judicial proceedings, the consequences of serious infringements of erga omnes obligations (including their effects on the jurisdictional immunity of the responsible State), the role that individuals may play in protecting general interests, the protection of community interests concerning natural resources.

La discipline de droit international privé a été dominée pour plus de trois siècles par la notion de conflits de lois, mais il n’y a point de conflits de lois. Des lois peuvent être différentes, certes, mais ce sont les gens qui entrent en conflit et non pas des lois. Ajouter une notion de conflit de lois ajoute un autre niveau de conflit et ne résout pas le véritable conflit. Créer des règles de droit international privé pour résoudre des conflits de lois est donc inutile et produit une complexité injustifiée. En revanche, la conciliation des lois s’impose de nos jours à cause de l’interdépendance croissante des Etats et la nature des conflits dans le monde. Elle correspond au développement de nouvelles logiques paraconsistantes et possède sa propre histoire, différente de l’histoire belliqueuse des conflits de lois. La conciliation des lois vient à la rescousse de la désintégration des règles de conflits de lois, et il y a un processus semblable de la conciliation des rôles des acteurs juridiques, de la conciliation des compétences, et de la conciliation des lois étatiques et non étatiques. - Contents:
