520 3  Der umfassende Rückgriff auf das IPR im Rahmen des Art. 35a Rating-VO stellt neben den Anlegern, Emittenten und Ratingagenturen auch die Gerichte vor Herausforderungen. Die Arbeit beschäftigt sich mit den Schwierigkeiten bei der Anwendung der Rom II-VO im Bereich der Finanzmarktdelikte am Beispiel der Ratinghaftung. Dabei wird das Problem der Lokalisierung von Vermögensschäden analysiert und die Notwendigkeit einer neuen Kollisionsnorm im Bereich des Kapitalmarktrechts in den Kontext der Materialisierung des Europäischen Internationalen Privatrechts eingeordnet. In diesem Zusammenhang findet auch der Vorschlag der Spezialkommission „Finanzmarktrecht“ des Deutschen Rats für Internationales Privatrecht Berücksichtigung.

This book deals with the difficulties of applying the Rome II Regulation on financial market torts using the example of the liability of Credit Rating Agencies. The problem of where exactly economic loss occurs is discussed as well as the need for a new Conflict of Laws rule for financial torts.
